The goal of the course is to provide a common intellectual background to enable categorizations and practical decisions when dealing with the Law of Trust
The course will be dedicated to the study of the Law of Trust and it will discuss the following questions: Historical and conceptual foundations of Trust; Creation and recognition of trust; Trust and public policy; Resulting Trust, Constructive Trust and Informal Trust; the parties (settlor, trustee, beneficiary); the regulation of Trust; the fiduciary duty; Rights and powers of the settlor and of the trustee; breach of trust; trust and third parties.
Frontal lessons, power point
Those who will attend the classes will be asked to do a series of 4 written test, having as a object the partial contents of the course discussed in the classes before each test. Otherwise the studenti s asked to hold an oral examination on the contents of the course text. In all cases, the answers provided will be evaluated taking into consideration, above all, their relevance and completeness, as well as the clarity of the exposition. Particular attention will be given to the ability to apply abstract concepts to concrete cases
